LA38A Public Service Law
  1. General
This course may be taught in either the first or second semester of the third year.
To facilitate the interaction the numbers will be limited to thirty students.
Students will be registered on a first come first served basis.

2. Course Objective

Public Service Law is designed to introduce students, especially those who plan
to specialise in Public Law and/or to seek employment in the public sector, to
the law governing the legal relationship between the several categories of
persons in the employment of the state, their rights and liabilities thereto and the
administration of the Public Service.

3. Course Content
i. Employment Status of Employees of the Crown or State
ii. Fundamental Rights and Freedoms of Employees of the State or Crown
iii. The Nature of and Content of the Contract of Employment
iv. Service Commissions:
(a) Composition and Membership
(b) Role and Functions
(c) Powers of Appointment, Discipline and Removal
(d) Judicial Review of Decisions of Service Commissions
v. Legal Status of Employees other than Public Officers
vi. Disciplinary Rules and Procedures
vii. Liabilities of Employees of the State or Crown

4. Method of Teaching

This course will be taught in three hours per week by a combination of lectures
and seminars.

5. Method of Assessment
i. Students will be assessed by either:

(a) One "take-home" assignment and one two hour examination at
the end of the semester in which it is taught, or
(b) a written examination
ii. Where option (a) is exercised by the Course Director, the "take home"
assignment will account for 25% of the final marks and shall be
submitted on or before the noon of the Monday which falls two weeks
before the commencement of the examinations in the semester in which
it is taught. In the written examination, the students will be required to
answer two questions from a total of six questions in two hours.
iii. Where option (b) is exercised, students will be required to answer three
questions from six questions in three hours.
iv. The Course Director will indicate which option will apply at the
commencement of the semester.
